1. Agreement to Terms
Welcome to BurnBound. By accessing or using our website at burnbound.io ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
2. Service Description
BurnBound is a free, publicly accessible tool that aggregates fire restriction and burn ban information across monitored jurisdictions. We collect data from public government sources and present it on an interactive map and status dashboard.
BurnBound is not affiliated with, endorsed by, or sponsored by any government agency. The use of agency names, data, and boundaries is for informational purposes only.
3. Data Accuracy Disclaimer
THE SERVICE AND ALL DATA, CONTENT, AND MATERIALS PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, BURNBOUND DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
Without limiting the foregoing:
- Fire restriction data may lag up to 6 hours behind official sources, and in some cases may be more significantly delayed
- Data may be inaccurate, incomplete, outdated, or entirely wrong at any given time
- Jurisdictional boundaries displayed on the map are approximations and may not align with actual legal boundaries
- Data sources may change their formats, URLs, or update schedules without notice, temporarily or permanently affecting data quality
- Automated scraping and processing may introduce errors that do not exist in the original source data
4. Assumption of Risk
By using the Service, you expressly acknowledge and agree that:
- Fire conditions are inherently dangerous and can change rapidly
- Relying on aggregated, automated data for fire safety decisions carries inherent risks
- You assume all risk associated with your use of or reliance on any data, content, or information provided through the Service
- You are solely responsible for verifying fire restriction status with official sources before making any fire-related decisions
5. Limitation of Liability
IN NO EVENT SHALL BURNBOUND, ITS OPERATORS, OWNERS, CONTRIBUTORS, AFFILIATES, OR ANY PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICE BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, PROPERTY, PERSONAL INJURY, OR ANY OTHER LOSSES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH:
- Your use of or inability to use the Service
- Any data, content, or information obtained through the Service
- Any decisions made or actions taken in reliance on information provided by the Service
- Any fines, penalties, injuries, property damage, or other consequences resulting from fire-related activities
- Unauthorized access to or alteration of your data
- Any errors, inaccuracies, omissions, or delays in the data
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BURNBOUND'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED TWENTY-FIVE DOLLARS ($25.00) OR THE TOTAL AMOUNT YOU HAVE PAID TO BURNBOUND IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, WHICHEVER IS LESS.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
6. Indemnification
You agree to indemnify, defend, and hold harmless BurnBound, its operators, owners, contributors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of or reliance on the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Any claim by a third party arising from your use of the Service
7. Class Action Waiver
YOU AND BURNBOUND AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You expressly waive the right to participate in any class action, collective action, or representative proceeding against BurnBound.
If this class action waiver is found to be unenforceable, then the agreement to arbitrate (Section 10) shall be null and void as to that particular claim, but shall remain enforceable as to all other claims.
8. User Responsibilities
- Verify with official sources: Always check with the relevant county, fire district, or federal agency before starting any outdoor fire or burn.
- Use good judgment: Even if no ban is shown, conditions may warrant caution. Follow local signage and ranger instructions.
- Report inaccuracies: If you notice incorrect data, please use our feedback form or Report Issue button to let us know.
9. Acceptable Use
You agree not to:
- Use automated tools to scrape, crawl, or otherwise extract data from the Service
- Attempt to access administrative or non-public areas of the site
- Misrepresent BurnBound data as official government information
- Interfere with or disrupt the Service or servers or networks connected to it
- Use the Service for any unlawful purpose
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict-of-law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding individual arbitration in the county of your residence (or, if outside the United States, in Denver County, Colorado). Arbitration shall be conducted under the rules of the American Arbitration Association (AAA).
Exception: Either party may bring a claim in small claims court if the claim qualifies under that court's jurisdictional limits.
11. Intellectual Property
The BurnBound name, original content, visual design, and source code are the property of BurnBound's operators. Fire restriction data is aggregated from public government sources and is presented with attribution to those sources.
Nothing in these Terms grants you any right to use the BurnBound name, logo, or branding for any purpose without prior written consent.
12. Termination
We reserve the right to suspend or terminate your access to the Service at any time, for any reason, without notice. You may stop using the Service at any time. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: limitation of liability, indemnification, class action waiver, and governing law.
13. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the updated Terms. If you disagree with any changes, your sole remedy is to stop using the Service.
14. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes what data we collect and how we use it.
